Introduction:

The subclass 300 visa, commonly referred to as the fiancé visa, is a temporary visa that allows individuals to travel to Australia to marry their partner within a 9-month visa period. After marriage, the individual is expected to apply for an onshore partner visa before the subclass 300 visa expires.

Application Process:

A permanent "Contributory" visa. The initial application fee is AUD 4,765 (main applicant). A second instalment of AUD 43,600 is required for each applicant.

• The onshore partner visa application is a 2-step process, where applicants lodge a combined application for a temporary visa (subclass 820) and a permanent visa (subclass 801) simultaneously.

• Two years after lodging the combined subclass 820/801 visa application, the applicant will be assessed for the subclass 801 visa. If successful, they will be granted permanent residence in Australia.

Eligibility:

• Applicants must be 18 years or older.

• They must intend to marry an Australian citizen, permanent resident, or an eligible New Zealand citizen.

• They must have met their partner in person after turning 18 and know each other personally.

• They must genuinely intend to marry their partner within 9 months of visa grant.

• There should be no legal impediment to the marriage in Australia.

• They must meet health and character requirements.

Evidence Requirements:

• Evidence of arrangements for the marriage ceremony.

• Notice of Intention to Marry (NOIM) lodged with the marriage celebrant.

• Evidence of a genuine intention to live together as spouses.

• Identity documents, character documents, relationship evidence documents, and written statements about the relationship.
  

Fees:

• Subclass 300 visa application fee: $8,085.

• Additional fees apply for other applicants (e.g., children).

Processing Times:

• The current average processing time for the subclass 300 visa ranges between 7 and 29 months.

Visiting Australia During Processing:

• Applicants might consider applying for a visitor visa to visit their partner in Australia while the subclass 300 visa is being processed.
  

After Visa Grant:

• Once the subclass 300 visa is granted, the visa holder must travel to Australia and marry their partner within the 9-month visa period.
