Introduction:

The Partner visas (subclasses 820 and 801) are designed for the partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to live in Australia.

Temporary Partner Visa (Subclass 820):

• This visa is granted first and allows the holder to stay in Australia. After 24 months, the visa holder may be eligible for the permanent Partner visa (Subclass 801).

Eligibility:

• Must be married or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen.

• Marriage must be valid under Australian law. If aged 16 or 17, parental permission is required.

• Must have been in a de facto relationship for at least 12 months.

• Must be inside Australia at the time of application and hold another visa type (e.g., student, visitor, working holiday).

• Cannot have an "8503 – No further stay" condition.

• Must meet health and character requirements.

Cost:

• AUD 8,850. If holding a Prospective Marriage visa (subclass 300), the cost is from AUD 1,870. This fee covers both the temporary and permanent visas. Additional fees may apply for family members, health checks, police certificates, and biometrics.

Location:

• Applicants must be in Australia when lodging the application and when a decision is made on the temporary Partner visa (Subclass 820). For the permanent Partner visa (Subclass 801), applicants can be in or outside Australia.

Duration:

• The temporary Partner visa (Subclass 820) lasts from the date it's granted until a decision is made on the permanent Partner visa (Subclass 801).

• The permanent Partner visa (Subclass 801) is indefinite.

Family:

• Dependent children or stepchildren can be included in the application.
  

Obligations:

• Visa holders and their children must comply with Australian laws and visa conditions.
